SHIFTEYE SESSIONS: TERMS & CONDITIONS

These Terms & Conditions apply to all photography sessions booked through Shifteye Sessions, operated by Shifteye Limited and Shifteye Photography (“Shifteye”).
By booking and paying for a Shifteye Session, you confirm that you have read and accepted these Terms & Conditions.
1. What is a Shifteye Session?
Shifteye Sessions are short, creatively directed photography sessions offered in a defined format at Shifteye Studios, Nairobi.
The exact theme, audience, creative direction, price and deliverables may vary between editions. The details advertised for the edition you book form part of your booking.
For the current Artists Edition, a Session includes:
One individual artist
One 30-minute photography session
One outfit/look
One advertised photographic setup
Direction throughout the Session
10 professionally selected and finished photographs
High-resolution and social-ready files
Delivery within five working days of the Session
Anything not specifically included above or in the advertised Session package is not included in the booking.
2. One Artist, One Look, One Setup
Each Artists Edition Session is designed for one individual.
Duos, groups, bands, teams or additional people are not included and require a separate arrangement with Shifteye.
The Session includes one outfit/look. Small styling adjustments, such as removing a jacket or changing an accessory, may be accommodated at the photographer’s discretion, but complete outfit changes are not included.
The advertised package includes one photographic setup. Shifteye may choose to introduce additional backgrounds, lighting variations or creative changes during the Session where time permits. Any such variation is entirely at Shifteye’s discretion and does not form part of the guaranteed deliverables.
3. Session Duration & Late Arrival
Sessions are scheduled for 30 minutes.
Please arrive on time and ready to be photographed. Late arrival will reduce the amount of photography time available and will not extend the Session beyond its scheduled end time.
Where a client arrives too late for Shifteye reasonably to complete the Session, the booking may be treated as a missed Session.
4. Preparing for Your Session
Unless otherwise agreed in writing, clients are responsible for arriving camera-ready, including their chosen outfit, grooming, hair and makeup.
A hair and makeup area may be available at Shifteye Studios for final touch-ups, but hair, makeup and styling services are not included in the Session price.
Small personal props may be used where appropriate, provided they can be incorporated safely and without substantially altering the setup or delaying the Session.
Please contact Shifteye in advance if you are unsure whether something you intend to bring can be accommodated.
5. Creative Direction
Shifteye Sessions are a creatively directed photography product.
By booking, you acknowledge that decisions concerning lighting, composition, posing and direction, backgrounds, framing, image selection, colour treatment and photographic finishing are part of Shifteye Photography’s creative process.
Reference images and examples may be used to communicate preferences, but Shifteye does not guarantee the exact recreation of another photograph, photographer’s work, pose, lighting treatment or visual style.
6. Image Selection
Shifteye Photography will review and select the strongest photographs from the Session.
For the Artists Edition, 10 photographs will be professionally finished and delivered.
Shifteye Photography makes the final image selection as part of the creative service. Unselected photographs are not part of the package and are not automatically available for viewing or delivery.
Additional finished photographs may be available on request and, where available, will be quoted separately.
7. Editing & Retouching
Delivered photographs receive Shifteye Photography’s normal professional finishing, which may include adjustments to:
Exposure and colour
Contrast and tonal balance
Cropping and composition
Minor skin and blemish retouching
Normal photographic finishing
Extensive retouching or alteration, including substantial body modification, major object removal, complex compositing, clothing alteration, background replacement or other significant manipulation, is not included unless agreed separately.
Shifteye’s objective is to produce polished photographs while retaining the natural appearance and character of the person photographed.
8. RAW & Unedited Files
RAW files, unedited photographs, test frames and rejected images are not included in Shifteye Sessions and will not ordinarily be supplied.
The deliverables are the professionally selected and finished photographs specified in the booked Session package.
9. Delivery
Artists Edition photographs will ordinarily be delivered digitally within five working days of the Session.
If an unforeseen circumstance is likely to cause a significant delay, Shifteye will communicate this to the client as soon as reasonably possible.
Clients are responsible for downloading and safely storing their delivered photographs. Shifteye does not guarantee indefinite storage or replacement of previously delivered files.
10. Payment & Booking Confirmation
The full Session fee is required to secure a booking unless Shifteye agrees otherwise in writing.
Selecting a date or submitting a booking request does not by itself guarantee the Session.
A Session is considered confirmed once Shifteye has accepted the booking and the required payment has been received.
11. Rescheduling
A confirmed Session may be rescheduled with at least 48 hours’ notice, subject to availability.
Requests made less than 48 hours before the Session may be treated as a cancellation or missed Session unless Shifteye agrees otherwise.
Any rescheduled Session remains subject to available Shifteye Sessions dates and times.
12. Cancellation & No-Shows
If you are unable to attend, please contact Shifteye as early as possible.
Payments for cancellations made less than 48 hours before a Session are ordinarily non-refundable.
Failure to attend a confirmed Session without notice will be treated as a no-show and the Session fee will be forfeited.
Where exceptional circumstances arise, Shifteye may allow a reschedule at its discretion.
13. Cancellation or Rescheduling by Shifteye
If Shifteye is unable to conduct a confirmed Session because of illness, equipment failure, venue issues or another circumstance within Shifteye’s responsibility, we will offer a suitable alternative date.
If a suitable alternative cannot reasonably be agreed, the amount paid for the affected Session will be refunded.
14. Copyright
Copyright in all photographs created during a Shifteye Session remains with Shifteye Limited / Shifteye Photography, except where otherwise agreed in writing.
Purchasing a Session provides the client with permission to use the delivered photographs in accordance with the usage rights below. It does not transfer copyright ownership.
15. Client Usage Rights
Artists Edition photographs may be used by the photographed artist for their own personal, editorial and self-promotional purposes, including:
Personal and artist social-media accounts
Artist websites and portfolios
Electronic press kits and artist biographies
Music and artist profiles
Press and editorial submissions
Promotional material for the artist’s own work, releases and performances
Posters, flyers and digital announcements promoting the artist’s own appearances or activities
The photographs may not be sold, sublicensed or supplied for unrelated third-party commercial advertising or brand campaigns without prior written agreement from Shifteye Photography.
If a brand, agency, company or other third party wishes to use a Session photograph commercially, please contact Shifteye to discuss the appropriate usage licence.
16. Alteration of Delivered Photographs
Clients may crop or resize delivered photographs as reasonably required for different platforms and layouts.
Please do not substantially alter the photographic treatment, apply heavy filters, use AI to materially modify the photograph, remove Shifteye’s editing or otherwise present a substantially altered version as Shifteye Photography’s finished work.
If you require an alternative crop, format or treatment, please ask us.
17. Credit
Where practical, we appreciate credit to Shifteye Photography and/or photographer Zachary Saitoti when photographs are published.
Unless specifically agreed as part of a commercial licence, failure to provide a credit does not prevent the client’s permitted use of the delivered photographs.
18. Shifteye’s Use of Your Photographs
Booking and paying for a Session does not by itself constitute blanket consent for Shifteye to use your likeness for advertising or promotional purposes.
Where Shifteye wishes to use identifiable photographs from your Session in its portfolio, website, social media, exhibitions, promotional materials or other public-facing uses, appropriate permission may be requested separately.
Any separate photography/model release will set out the permissions being requested.
19. Personal Property
Clients remain responsible for their clothing, equipment, jewellery, phones, bags and other personal belongings while at Shifteye Studios.
Please do not bring unnecessary valuables to your Session.
Shifteye will take reasonable care but cannot accept responsibility for loss or damage except where liability cannot lawfully be excluded.
20. Conduct & Safety
Clients must follow reasonable instructions from Shifteye staff concerning use of the studio, equipment and premises.
Shifteye reserves the right to stop or refuse a Session where behaviour is abusive, threatening, unsafe, unlawful or likely to cause damage to people, equipment or the premises.
Where a Session is terminated because of a client’s serious misconduct, a refund will not ordinarily be provided.
21. Damage
Clients may be responsible for the reasonable cost of repairing or replacing Shifteye property or equipment damaged through deliberate action, misuse or negligence by the client or anyone accompanying them.
22. Circumstances Beyond Our Control
Shifteye will not be responsible for failure or delay caused by circumstances reasonably beyond our control, including significant power or infrastructure failure, severe weather, government restrictions, civil disruption or other exceptional events.
Where such circumstances prevent a Session from taking place, Shifteye will make reasonable efforts to reschedule the booking.
23. Changes to Shifteye Sessions
Shifteye Sessions may be offered as different editions throughout the year.
Pricing, Session duration, deliverables, creative concepts and availability may therefore change between editions.
Any subsequent change to the Sessions programme will not alter the agreed package for a booking that has already been confirmed and paid for, unless agreed with the client.
